The Terms and Conditions govern your use of Spotlight247 and any services contained within the Site.
1. Introduction.
This page contains the Terms and Conditions governing your access to and use of the SpotLight247 ™ site. If you do not accept these Terms and Conditions you may not use the Site. If you are an employer using the Site, you may have entered into a Service Agreement with SpotLight247 ™, in which case these Terms and Conditions, including the Exhibits attached hereto, are part of and incorporated into that Service Agreement. These Terms and Conditions are effective as of April 1st, 2007
2. Binding Agreement.
These Terms and Conditions form an agreement between you and SpotLight247 ™. Your access to or use of the Site indicates your acceptance of these Terms and Conditions. You are agreeing to use the Site at your own risk.
The terms and conditions of SpotLight247 are subject to change at any time without any notice. We strongly recommend that all users should review the terms and conditions every time they intend to use the site.
3. Certain Definitions.
The following definitions apply to this Agreement: "SpotLight247 ™ Web Site" or the "Site" includes www.SpotLight247.com in its entirety and its related sites owned or operated by SpotLight247 ™, and includes their Content, Text, Videos, Photos, Graphics, Design, Programming and Services as applicable in the context.
"Content" includes all Text, Videos, Photos, Graphics, Design and Programming used on the Site. "Text" includes all text on every page of the Site, whether editorial, navigational, or instructional. "Graphics" includes all logos, buttons, and other graphical elements on the Site, with the exception of paid advertising banners.
"Design" includes the color combinations and the page layout of the Site. "Programming" includes both client-side code (HTML, JavaScript, etc.) and server-side code (Active Server Pages, VBScript, databases, etc.) used on the Site.
"Document" refers to any posting to the Site, whether job or resume. "Services" means any services provided on the Site by SpotLight247 ™ or its agents. "User" refers to any individual or entity that uses any aspect of the Site.
"Job Seeker" means a User who is accessing the Site to search for a job or in any other capacity except as an Employer.
"Employer" means a person or entity that is accessing the Site to post a job or for any reason related to the purpose of seeking candidates for employment.
"Member" means any person or entity that use of site for the purpose of posting Jobs, Seeking Employment, Posting Videos, Photos or using the site for the sole purpose of entertainment.
"You" and "you" means the person who (or the entity on behalf of whom you are acting) that is agreeing to these Terms and Conditions.
4. Eligibility
You must be legally adult or 18 yrs. Old as defined in your area of jurisdiction, whichever is older to visit or use www.spotlight247.com. By accepting terms of use you testify to Spotlight247 that you have reached age of adulthood in your jurisdiction.
5. Risks
5.1 General risk associated with use of site
The users and visitors of Spotlight247 must understand potential and real risks involved with use of internet and interacting and sharing information over the internet with people you do not know and have never met. NEVER PROVIDE SOCIAL SECURITY NUMBER, CREDIT CARD NUMBERS, OR BANK ACCOUNT NUMBERS TO ANYONE INCLUDING PROSPECTIVE EMPLOYERS OVER THE INTERNET. User must understand user verification and authentication is impossible over internet and Spotlight 247 does not take responsibility that each user is what they claim to be. Spotlight247 will not and does not involve itself in user to user interaction, therefore by agreeing to use Spotlight247 in event of a dispute you agree to release Spotlight247, its employees, officers, and agents from all the claims, damages, and responsibilities of every kind and nature/known or unknown/suspected or unsuspected, and present or in future. The Spotlight247 does not verify the nationality, gender, or age of its users. So there is a danger of potential harm/mental, emotional, or physical in nature of dealing with unknown people, strangers, foreigners, and underage people acting under false pretenses. By agreeing to these" terms of use" you assume all the risks of dealing with strangers with whom you came in contact by using Spotlight247.com. By agreeing to "terms of use" you acknowledge to understand that information provided by users may be false, misleading, and deceptive or even harmful.
Spotlight247.com site may be down or unavailable from time to time for technical reasons, routine maintenance and updating. Spotlight247 does not guarantee that its services are available 24/7, uninterrupted and error free. Spotlight247 does not guarantee that it is free of viruses and other mechanisms that may be harmful to your computer or software and does not accept responsibility to any damage caused to your computer or software or loss of data caused by the use of Spotlight247.
Spotlight247.com does not mandate its users or job seekers to post video resumes and such posting is entirely voluntary.
5.2 Special warning to the Job Seekers
Spotlight247.com provides a platform for the job seekers and employers to post resumes, jobs and other information that can be used to facilitate the process for seeking jobs or employees. THE SPOTLIIGHT247 DOES NOT ENDORSE, RECOMMEND OR AUTHENTICATE ANY JOB LISTINGS OR COMPANIES THAT POST JOBS. IT IS ENTIRELY POSSIBLE THAT INFORMATION PROVIDED BY COMPANIES, JOB SEEKERS OR BROKERS MAY BE FALSE, MISLEADING, DECEPTIVE OR EVEN HARMFUL. THE USERS OF SITE INCLUDING COMPANIES, EMPLOYERS, BROKERS OR OTHER MEMBERS MAY PRETEND TO BE WHAT THEY ARE NOT OR EVEN POST FAKE JOBS THAT MAY BE OUT RIGHT FRAUDULENT OR COMPANIES MAY NOT EVEN EXIST. SPOTLIGHT247 DOES NOT ASSUME ANY RESPONSIBILITY IN TERMS OF ANY FINANCIAL, PHYSICAL, EMOTIONAL OR BODILY INJURY OR LOSS. IT IS YOUR RESPONSIBILITY AS A MEMBER OF SPOTLIGHT247 TO USE ALL THE RESOURCES AND MEANS TO CHECK THE AUTHENTICITY OF THESE POSTINGS. IF ANY ILLEGAL OR FRAUDULENT ACTIVITY IS DETECTED OR NOTICED BY THE MEMBERS OR THE USERS OF SITE, IS YOUR RESPONSIBILITY TO BRING SUCH ACTIVITY TO THE NOTICE OF THE MANAGEMENT OF SPOTLIGHT247.COM.

SpotLight247.com is a website providing a platform for interaction between job-seekers and employers. We do not endorse, verify, authenticate, or approve any of the information provided by either job-seekers and employers. We do our best to eliminate fraud and abuse by our users. We also reserve the right to verify details provided by users from time to time by all legal means to us, including telephone calls, e-mails, etc. We reserve the right to delete or disable any information if we are not able to confirm its accuracy.
By the nature of business conducted on the internet, when you have users who have never personally met each other, the probability of abuse and fraud are likely. You should especially be careful to situations where an employer asks for money up front, initiation fees, bank account information, social security number, credit card number, or requests a bank/wire transfer. You should also be careful about get rich quick schemes, work from home schemes, and pyramidal schemes. REMEMBER If it sounds to good to be true, it probably is. If you notice any suspicious activity, you are encouraged to contact SpotLight247.com immediately. By agreeing to our terms and conditions, you are responsible for any potential financial or emotional risk that may arise. If you are not willing to assume this responsibility, you must not use this site.

During the course of registration, you will be providing us private information including, but not limited to: Name, Phone Number, E-mail Address, Password, your previous employment history, education, logos, photos, videos, address and employment details. As an employer, you will also be providing your company information. SpotLight247 will not sell your private information to any third parties. However, the information you provide us may be freely available to other users of our site including recruiters, job-seekers, and employers. SpotLight247 cannot control who accesses this information, and what they choose to do with it. We highly respect your privacy. We will not sell or disclose this information to anybody other than registered members of our website for the purpose of gaining or seeking employment. We cannot guarantee that your information will be kept private. Since we cannot authenticate, verify, or approve all users on our site, we cannot guarantee that your information will not get into undesirable hands. If you are not willing to assume this risk, you should not use this site.
6. Interviews
Spotlight247 provides only online interaction between its users and does not arrange or involve itself in face to face interviews. To arrange such interviews is the sole responsibility of the job seekers and employers at their own terms and conditions, expenses, and at their own risk. Spotlight247 does not confirm, endorse, verify, or authenticate any applicants or employers. As a general recommendation it is prudent that such interviews be carried out in an office environment, during normal business hours, and after verification of the location, existence, and nature of the business establishment by all available means. Spotlight247 does not guarantee the safety of the employers or job seekers during the interview process. By agreeing to use Spotlight247.com you assume all the risks involved in such activities, actions, and processes. Interviews or meetings between its users at their homes, hotels, restaurants, bars, or discos is not recommended. Video resumes/Pictures, when posted, are provided solely on "As Is" basis as generated by its users. Spotlight247 has no role in production, posting, or editing of actual videos. Spotlight247 does not verify or accuracy or truthfulness of the videos. Spotlight247 does not verify the copyright issues involved in the production and posting of videos. It is the responsibility of the employer to use all the other means to verify and authenticate such information by all other means including reference check, phone calls, correspondence, and actual interviews. Offering a job solely based upon pictures or video resumes is not recommended.
7. Acceptable Use of the Site.
7.1 General Use Rules.
The Site is intended for individuals seeking employment and for employers or recruiters seeking candidates for employment. You may use this Site only for lawful purposes within the stated context of SpotLight247 ™'s intended and acceptable use of the Site. SpotLight247 ™ is the sole interpreter of the Site's intended and acceptable use
7.2 License to Use by Users who are Job Seekers.
SpotLight247 ™ grants you the right to access and use the Site only for your personal use seeking employment opportunities for yourself. You solely determine the length of your posting. This authorizes you to view and download a single copy of the material on the Site solely for your personal, noncommercial use. You agree that you are solely responsible for the content of any Document you post to the Site and any consequences arising from such posting. Your use of the Site is a privilege. SpotLight247 ™ reserves the right to suspend or terminate that privilege for any reason at any time, at its sole discretion.
7.3 License to Use by Users who are employers and recruiters.
SpotLight247 ™ grants you the right to access and use the site only to seek candidates for employment by posting job openings and creating company profiles and videos. This authorizes you to view and download a single copy of the material on the Site solely for your personal use directly related to using the Site for the purpose of searching and recruiting job prospects. The some of the information like address, phone numbers and email addresses provided by our seekers is highly personal, private and confidential in nature. You agree that you will not misuse, sell or disclose such information to any other party without written permission of job seekers and SpotLight247.com. You may not sell, transfer or assign any products or services or your rights to any products or services (including access to the Resume Database) provided by SpotLight247 ™ to any third party without the express written authorization of SpotLight247 ™. You agree that you are solely responsible for the content of any Document you post to the Site and any consequences arising from such posting. SpotLight247 ™ reserves the right to suspend or terminate your access and use at any time if SpotLight247 ™ determines that you are in breach of any of these Terms and Conditions.
7.4 Other Specific Rules.
You represent, warrant and agree that you will not use (or plan, encourage or help others to use) the Site for any purpose or in any manner that is prohibited by these Terms and Conditions or by applicable law. It is your responsibility to ensure that your use of the Site complies with these Terms and Conditions and all applicable laws.
8. House Rules for Posting, Conduct and Security.
You agree to comply with the "House Rules" for posting, conduct and security on the Site which are discussed in this document
9. Disclaimers and Limitations on SpotLight247 ™'s Liability.
9.1 Allocation of Responsibility
SpotLight247 ™ assumes no responsibility for Documents posted by Users and no responsibility for the activities, omissions or other conduct of Users. SpotLight247 ™ acts as a portal for the online distribution and publication of User submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring Documents posted by Users. If notified by a User of a Document which allegedly does not conform to this agreement, SpotLight247 ™ may investigate the allegation and determine in good faith and in its sole discretion whether to remove or request the removal of such Document. SpotLight247 ™ has no liability or responsibility to Users for performance or nonperformance of such activities. SpotLight247 ™ may take any action with respect to User submitted information that it deems necessary or appropriate, in its sole discretion.
9.2 No endorsements by SpotLight247 ™.
Nothing on the Site shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regards to its web site, products, services, hiring, experience, employment or recruiting practices, or otherwise.
9.3 No Guaranty of Results.
SpotLight247 ™ is not an employment agency or a recruiting firm, and makes no representations or guarantees regarding the effectiveness or timeliness of the Site in meeting the employment objectives of Users. SpotLight247 ™ does not guarantee that Documents posted by Users will result in candidates being hired or positions being filled, and is not responsible for any employment decisions, for whatever reason made, made by any User.
10. Links to Other Sites.
SpotLight247 ™ contains links to third party web sites. These links are provided solely as a convenience to you, and not as an endorsement by SpotLight247 ™. SpotLight247 ™ is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party web sites. If you decide to access linked third-party web sites, you do so at your own risk.
11. Amendments to this Agreement and Changes to Site.
SpotLight247 ™ may revise this Agreements at any time by updating this page. Changes will be binding on you on the date they are posted on the Site (or as otherwise stated in the any notice of such changes). Any use of the Site will be considered acceptance by you of the then-current Terms and Conditions (including any Exhibits thereto). If at any time you find the Terms and Conditions unacceptable, you may not use the Site any longer. the Site at any time.
12. Indemnity.
You agree to defend, indemnify, and hold harmless SpotLight247 ™ (and its officers, directors, employees and agents) from and against any third party claims, actions or demands (including, without limitation, costs, damages and reasonable legal and accounting fees) alleging or resulting from or in connection with your use of the Site, any Document posted by you, or your breach of this Agreement. SpotLight247 ™ shall use reasonable efforts to provide you prompt notice of any such claim, suit, or proceeding and may assist you, at your expense, in defending any such claim, suit or proceeding.
13. User Information.
The Privacy Policy posted on the Site is incorporated into this Agreement by this reference. The Privacy Policy governs data collected through SpotLight247 ™'s on-line operations only. Please note, as set forth in the Privacy Policy, that SpotLight247 ™ may collect certain personal information from Users and may contact Users periodically in accordance with the terms of the Privacy Policy. In addition, SpotLight247 ™ reserves the right to comply, in its sole discretion, with legal requirements, requests from law enforcement agencies or requests from government entities, even to the extent that such compliance may require disclosure of certain information collected from Users.
14. Questions and Notices.
Questions concerning the use of the Site should be directed to Contact Us. Notices shall be sent, for SpotLight247 ™, to the address listed on the Site, and, for you, to the address submitted by you or such other address as SpotLight247 ™ reasonably determines is an appropriate address for you.
15. General.
SpotLight247 ™ contact information is listed on the Site If you access SpotLight247 ™ site from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. This Agreement and your Service Agreement, if you have one, are governed by the internal substantive laws of the State of Illinois, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this Agreement or your Service Agreement shall lie exclusively with the state or federal courts in the State of Illinois. The sole relationship between You and SpotLight247 ™ is that of independent contractors. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of all or part of a provision shall not affect the validity of the remaining parts and provisions of this Agreement, which shall remain in full force and effect. All provisions of this Agreement shall survive termination except those granting access or use to the Site, and you shall cease all your use and access thereof immediately. You may not assign or transfer your obligations under this Agreement. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.
A1. Posting Rules:
- Your Document may not contain:
- URLs or links to Web sites (to advertise your company or Web site, see our Advertising Info page.);
- copyrighted material (unless you own the copyright or have the owner's permission to post the copyrighted material);
- trade secrets (unless you own them or have the owner's permission to post them);
- material that infringes on or misappropriates any other intellectual property rights, or violates the privacy or publicity rights of others;
- keywords or white text keywords (including any words embedded in the Document and hidden from the User);
- anything that is discriminatory, sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful; or
- anything that is embarrassing or offensive to another person or entity.
- You may not use your Document(s) to:
- impersonate another person, living or dead;
- post false, inaccurate or misleading information;
- post advertisements or solicitations of business (including, but not limited to, Email Processors, Project 21, franchises, "club memberships," distributorships, or anything requiring a monetary investment by the User, including a request for payment to obtain job listings);
- post chain letters or pyramid schemes; or (v) post opinions or notices, commercial or otherwise.
- Your Document(s) must contain sufficient detail to convey clearly to the User the nature and requirements of the job opportunity, or your qualifications as a candidate for employment. Documents that encourage the User to "email for more details" are not permitted. Documents from any third party charging a fee or restricting complete access to all resume information are prohibited.
- Job postings must be individual openings for traditional, W-2 or 1099 employees.
- Resume postings must contain the accurate resume of a living individual seeking employment on a full-time, part-time, or contractual basis on his or her own behalf.
- SpotLight247 ™ is under no obligation to monitor the Documents posted on the Site, but it may monitor Documents at random. Documents found to violate the above Posting Rules may be removed at SpotLight247 ™'s discretion.
A2. Conduct Rules:
- You may not respond to postings by other Users in any manner or for any purpose other than that which is expected (i.e., to apply for the job or to initiate further discussion with the candidate). Communications soliciting the employer's business by our competitors are prohibited.
- You may not send unsolicited commercial email to Users.
- Protect your password. You are responsible for maintaining the confidentiality of your information and password. You are responsible for all uses of your registration, whether or not authorized by you. If others use your password to post inappropriate material on the Site, you risk losing your access to the Site. You agree to notify SpotLight247 ™ immediately of any unauthorized use of your registration and password.
- Report inappropriate postings or conduct to Feedback.
- You may not delete or revise any material posted by any other person or entity.
- If at any time during the term of this agreement SpotLight247 ™ comes to the understanding that you: (i) misled SpotLight247 ™ of your business practices and/or services, or (ii) purchased services that do not represent your precise business, SpotLight247 ™ reserves the right to terminate this agreement.
- SpotLight247 ™ is under no obligation to monitor the conduct of its Users, but it may investigate and respond when violations are reported.
A3. Security Rules:
- Users are prohibited from violating or attempting to violate the security of the Site, including, without limitation:
- accessing data not intended for such User or logging into a server or account which the User is not authorized to access;
- attempting to test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
- attempting to interfere with service to any User, host or network.
- Sending unsolicited e-mail, including promotions and/or advertising of products or services;
- forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability.
- Violation of these Security Rules may result in civil or criminal liability. SpotLight247 ™ will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.
A4. Miscellaneous Rules:
- The SpotLight247 management reserves the rights to randomly check and verify the email address, phone numbers and other information posted by its users including employers, job seekers and members. If the management is unable to verify or authenticate such information the account can be terminated.
- Any company posting more than 10 jobs within 24 hour period will be, at the decision of management subject to administrative review of all the postings. During this review process account may be temporally suspended until this review is complete. This will be particularly applicable to numerous identical jobs posted with in very short period of the time.
16. Spotlight247 videos/photos:
The Spotlight247 terms and conditions discussed above are also applicable to the video/photo section of the Spotlight247 website. The videos/photos section of the Spotlight247 website is provided solely for the purpose of entertainment, sharing, storing, or exchanging videos produced/edited and posted by its users. The SpotLight247 does not produce, edit, or control the content of the videos/photos but reserved the right to remove/delete any videos/photos that may be considered inappropriate, defamatory, or offensive. The videos/photos violating copyright laws will also be removed and deleted when our viewers, users, or our own internal surveillance bring such violations to our notice from time to time.
Spotlight247 does not allow nudity, pornography, or racially motivated material on its website. Although Spotlight247 consistently looks out for these violations and tries to remove/delete such material from the website as soon as possible, it does not guarantee that this breech/violation insecurity will not occur from time to time due to the viewer generated nature of its content. As a user of Spotlight247, it is YOUR responsibility as well to bring such issues to the Spotlight247 management as soon as they come to your notice. By agreeing to the terms and conditions of Spotlight247, you accept the risk of exposure to unacceptable/offensive/pornographic material by your use of Spotlight247 website. If you are not willing to accept this risk, you should not become a member of Spotlight247.com.
Spotlight247 reserves the right to report such activities as pornography, child pornography, racial issues, defamatory postings, or any other issues or postings done with the intent of deceiving or misleading others or with the intent of causing emotional or physical harms to others to appropriate law enforcement agencies.
17. SpotLight247 accounts:
In order to access some parts of Spotlight247, you will be required to create a Spotlight247 account protected by a password. This is your sole responsibility to keep your password safe, secure, and protected. You may never use another person's account without permission. This is your responsibility to provide accurate and complete information. You must notify Spotlight247 immediate if any breech obscurity or any unauthorized use of your account has occurred.
You agree that Spotlight247 will not be liable for any losses caused by unauthorized uses of your account. However, you may be held liable for losses of Spotlight247 or its users due to such unauthorized use.
17.1 Refund Policy
SpotLight247.com does not offer a guarantee to results. That means, if you are an employer who posts jobs, we cannot guarantee that you will be able to hire someone within a reasonable amount of time. We also do not guarantee that you will find or get qualified resumes. If you are a job-seeker, there is no guarantee that you will find employment. Once you have purchased a job listing, there will be no refund. If you purchase a package of 5 jobs or more and request a refund of the unused part of your package, please be advised that there will be a 20% penalty and handling fees, and the used part of the package will be prorated at the rate of single postings.
18. Account termination policy:
Spotlight247 reserves the right to determine whether the content/videos/photos under submission are appropriate, acceptable, and comply with its terms and conditions. Any posting of material that violates the terms and conditions including copyrighted material, defamatory material, racial material, pornography, and material of excessive length will be denied. Spotlight247 may terminate such users and their accounts at any time without any prior notice at its sole discretion.
19. Legal Jurisdiction
By visiting or using Spotlight247, you agree that SpotLight247 will be deemed solely based in Dupage County in the state of Illinois in the USA. These terms and conditions will be governed by the laws of the state of Illinois. Any conflict or dispute between you and Spotlight247 that arises in whole or in part from Spotlight247 will be decided exclusively by a court of competent jurisdiction located in Dupage County in Illinois. FURTHER YOU AND SpotLight247 AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF A DISPUTE RELATED TO SPOTLIGHT247 MUST COMMENCE WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUSE. OTHERWISE SUCH CAUSE OF ACTION IS PERMANENTALY BARRED.
20. Some Important Tips To Use When Dealing With Prospective Employers
- Never give out your social security number to a prospective employer.
- Never provide credit card or bank numbers or monetary transaction of any sort.
- Be cautious when dealing with contacts outside of your own country.
- Do not provide any non-work related personal information (i.e. social security number, eye color, marital status, etc.) over the phone or online.
- A personal interview should always be conducted in a normal office environment. Never agree to conduct an interview or meet some one in a hotel, restaurant or home.
- Be careful with easy money and get rich quick schemes that may appear on the site from time to time and we have no way to authenticate these postings.
- We extremely skeptical for those offers that ask money upfront, application fees, registration fees or initiation fees.
